1. Acceptance of Terms

By accessing, browsing, or using sHub ("the Platform", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Platform. These Terms constitute a legally binding agreement between you and sHub.

2. Eligibility

You must be at least 13 years of age to use the Platform. If you are under 18, you must have obtained parental or legal guardian consent to use the Platform. By using the Platform, you represent and warrant that you meet these eligibility requirements. Schools and educational institutions may enter into separate agreements with sHub for institutional use.

3. Account Registration & Security

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete account information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorised access or security breach
  • Accept all responsibility for activity that occurs under your account

We reserve the right to disable any account at any time if we suspect a violation of these Terms or unauthorised access.

4. Service Description

sHub is a study management platform designed for students undertaking the South Australian Certificate of Education (SACE). Core features include:

  • LMS integration (Canvas, Daymap) for synchronising assignments, deadlines, and grades
  • Unified calendar merging school data with external calendars
  • AI-powered study planning and scheduling
  • ATAR estimation based on indicative grade-to-ATAR mappings
  • Note-taking with knowledge graph visualisation
  • Smart reminders via push notification, email, and in-app alerts
  • Flashcard and quiz generation from notes

Features may be added, modified, or removed at our discretion. We will use reasonable efforts to notify users of material changes.

5. ATAR Estimator — Disclaimer

The ATAR estimator tool provides indicative estimates only. ATAR calculations are performed by the South Australian Tertiary Admissions Centre (SATAC) using official SACE Board results. The estimates displayed on sHub:

  • Are based on self-reported or synced grade data and historical scaling information
  • May not reflect actual scaled scores, moderation adjustments, or final ATARs
  • Do not constitute official academic advice or guaranteed outcomes
  • Must not be relied upon for subject selection, tertiary applications, or any academic decision

You should consult official SACE Board resources, SATAC publications, and your school's career counsellor for accurate information.

6. AI Features — Disclaimer

sHub incorporates artificial intelligence and machine learning features, including AI-generated study plans, flashcards, and quizzes. You acknowledge that:

  • AI-generated content may contain errors, inaccuracies, or omissions
  • You should independently verify any AI-generated academic content
  • AI outputs do not constitute professional educational advice
  • You are responsible for reviewing and approving any AI-generated materials before use
  • AI features are powered by third-party providers (including but not limited to Google Gemini, Groq, and OpenRouter) and their respective terms and privacy policies apply to data transmitted to those services

7. LMS Integration — Authorisation

By connecting an LMS account (Canvas, Daymap, or other supported platforms), you authorise sHub to:

  • Access your course materials, assignments, grades, calendar events, and announcements
  • Store synchronised data on our infrastructure for the purpose of providing the Service
  • Periodically poll the LMS API for updates

You represent that you have the authority to grant this access. You may revoke access at any time through your account settings or by disconnecting the integration. Revocation may affect the availability of certain features.

8. Acceptable Use & Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
  • Attempt to gain unauthorised access to any part of the Platform, other accounts, or connected systems
  • Interfere with or disrupt the integrity or performance of the Platform
  • Upload or transmit viruses, malware, or any malicious code
  • Scrape, crawl, or otherwise collect data from the Platform without our written consent
  • Impersonate any person or entity, or misrepresent your affiliation
  • Use the Platform to transmit spam, phishing attempts, or unsolicited communications
  • Reverse-engineer, decompile, or disassemble any part of the Platform
  • Use the Platform in a way that could harm minors or expose them to inappropriate content
  • Submit false or misleading information, including fraudulent grade or assessment data

9. Intellectual Property

The Platform, including its code, design, logos, trademarks, and content (excluding user-provided content), is owned by sHub and protected by Australian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for its intended purpose. No other rights are granted.

You retain ownership of any content you submit to the Platform ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, synchronise, display, and analyse your content solely for the purpose of providing the Service.

10. Third-Party Services & Links

The Platform integrates with or links to third-party services, including but not limited to:

  • Infrastructure: Supabase (PostgreSQL), Cloudflare R2 (object storage), Upstash (Redis + QStash)
  • AI Providers: Google Gemini, Groq, OpenRouter (with optional OpenAI/Anthropic)
  • Communications: Resend (email), Sentry (error monitoring)
  • LMS Platforms: Canvas, Daymap

We are not responsible for the content, privacy practices, or terms of third-party services. Your use of integrated services is subject to their respective terms and policies. We do not warrant the availability or reliability of any third-party service.

11. Data Handling & Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms. You acknowledge that:

  • We collect and process data as described in the Privacy Policy
  • Data may be processed in Australia and other jurisdictions where our infrastructure providers operate
  • We implement reasonable security measures but cannot guarantee absolute security
  • You are responsible for the accuracy of the data you provide

12. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that:

  • The Platform will be uninterrupted, timely, secure, or error-free
  • Any information or content obtained through the Platform will be accurate or reliable
  • Defects will be corrected
  • The Platform is free of viruses or other harmful components

We are not responsible for any academic outcomes, including but not limited to ATAR results, subject completions, or university admissions, that may be influenced by use of the Platform.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL sHub, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM.

Our total liability to you for any claim arising from or relating to these Terms or the Platform shall not exceed the amount paid by you to us in the 12 months preceding the event giving rise to the liability. If no fees have been paid, your sole remedy shall be discontinuing use of the Platform.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law. If the Australian Consumer Law applies, our liability for a breach of a non-excludable guarantee is limited, at our option, to: (a) re-supplying the Service; or (b) the cost of re-supplying the Service.

14. Indemnification

You agree to indemnify, defend, and hold harmless sHub and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your User Content
  • Your violation of any third-party rights, including intellectual property or privacy rights

15. Termination

We may suspend or terminate your access to the Platform at any time, without prior notice, for any reason including:

  • Violation of these Terms
  • Conduct that we believe could harm other users, third parties, or sHub
  • Extended inactivity
  • Following a request by law enforcement or government agency

Upon termination, your right to use the Platform ceases immediately. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law shall survive termination. You may delete your account at any time through your account settings. We will delete or anonymise your personal data in accordance with our Privacy Policy and applicable law.

16. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of South Australia, Australia. Any disputes arising out of or relating to these Terms shall be resolved exclusively in the courts of South Australia.

Before initiating legal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at support@shub.com. If the dispute cannot be resolved within 30 days, either party may pursue formal resolution.

Notwithstanding the foregoing, we may seek injunctive or equitable relief in any jurisdiction where necessary to protect our rights or intellectual property.

17. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and sHub regarding your use of the Platform, superseding any prior agreements or understandings.

19. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. We will use reasonable efforts to notify registered users of material changes via email or in-app notification. Your continued use of the Platform after changes constitutes acceptance of the modified Terms. If you do not agree, you must stop using the Platform.
